Terms of Service

These Terms of Service ("Terms") govern your use of the Still Sky meditation, mindfulness and nature-sound application, our website and related services (together, the "Service").
The Service is currently operated by Anurag Tripathi, a sole proprietor in India trading as Still Sky ("Still Sky", "we", "us" or "our").
By creating an account, starting a subscription or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use Still Sky
You must be at least 18 years of age and legally able to enter into a contract. If the law where you live requires a higher age, that higher age applies. By creating an account, you confirm that you meet this age requirement.
You must provide accurate account information, keep your login details secure and tell us promptly if you believe your account has been used without permission. You are responsible for activity through your account. An account is for one person unless Still Sky expressly offers a plan that allows otherwise.
Still Sky may allow you to create or access your account using Sign in with Apple, Sign in with Google, Facebook Login or email. If you use a third-party sign-in service, that provider's applicable terms and privacy policy may also apply, and you authorise us to receive the limited account information the provider makes available, as described in our Privacy Policy.
2. What Still Sky provides
Still Sky provides meditation, mindfulness, nature sounds and related general-wellness content. Some features may be free and others may require a paid subscription.
We may improve, add, remove or change features and content over time. We do not promise that a particular meditation, sound, feature or device integration will always remain available. Updates may be required for the Service to work properly. You are responsible for your device, internet connection and any related charges.
If you voluntarily send us feedback, ideas or suggestions about Still Sky by email or through a feedback feature we make available, you permit us to use, adapt and incorporate that feedback to operate, develop or improve the Service without payment or other obligation to you. Do not submit confidential information or material you do not have the right to provide. This does not affect how we handle personal information under our Privacy Policy.
The Service is offered only in countries and regions where we make it available through an applicable app store. We do not represent that the Service is appropriate or available everywhere. You must comply with applicable local law and must not access or use the Service where doing so is prohibited.
3. Wellness and safety
Not medical care. Still Sky is for general wellness and education. It is not a healthcare service, medical advice, diagnosis, treatment, therapy or an emergency or crisis service.
The Service is not a substitute for advice or care from a qualified professional. Do not ignore or delay professional advice because of anything in Still Sky. Results differ from person to person, and we do not promise any particular health, sleep, mood or performance outcome.
Use the Service in a safe place. Do not meditate, listen or use features when doing so could distract you from driving, operating machinery or another activity that needs your full attention. Stop if you feel unwell or distressed and seek appropriate help. In an emergency, contact your local emergency services. If you believe you may harm yourself or another person, contact your local emergency services or an appropriate crisis service immediately.
4. Subscriptions and payment
Subscriptions purchased through Apple's App Store are billed and processed through the App Store under Apple's applicable payment terms. Before you confirm a purchase, the App Store shows the price, billing period and applicable taxes.
Subscriptions purchased through Google Play are billed and processed through Google Play under Google's applicable payment terms. Before you confirm a purchase, Google Play shows the price, billing period and applicable taxes.
Receipts, invoices and other billing documents for an app-store purchase are issued or made available by the store that processed the purchase, subject to applicable law.
Automatic renewal
A subscription automatically renews for the same billing period unless you cancel it before the renewal date in accordance with the applicable app store's rules. The store charges the payment method linked to your store account. If payment cannot be completed, paid access may be interrupted or end.
Cancellation
You can manage or cancel a subscription through the subscription settings of the app store that billed you. Cancellation normally takes effect at the end of the current paid period, subject to that store's rules. Deleting the App or your Still Sky account does not cancel an app-store subscription.
Refunds and price changes
Refund requests for app-store purchases are handled by the store that billed you under its policies and applicable law. We cannot directly issue a refund for a purchase processed by an app store. Subscription prices may change; the applicable store will provide any notice or request for consent required by its rules or applicable law. The price shown by that store for your next purchase or renewal controls.
Trials and promotional offers
Still Sky may occasionally offer free trials, discounts or other promotional access to eligible users. The availability, duration, eligibility, price after the promotional period and any applicable conditions will be shown before you confirm the subscription. Unless stated otherwise, any trial will convert to a paid, automatically renewing subscription unless cancelled before the trial ends through the applicable app store.
5. Your licence to use the Service
Still Sky owns, or has obtained the rights or licences needed to use, the Service and its software, meditation scripts, recordings, voiceovers, sounds, music, images, artwork, text, designs, trade marks and other content. These materials are protected by copyright, trade mark and other intellectual-property laws. Rights in third-party materials remain with their respective owners. The Service is licensed, not sold, to you.
We give you a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to use the Service for your own non-commercial purposes, on devices you own or control and subject to the applicable app-store rules. No other rights are granted.
6. Acceptable use
You must not:
- copy, record, reproduce, extract, download, publicly perform, publish, distribute, sell or commercially exploit the Service or its content except where the Service clearly permits it;
- share, sell or transfer account access, or use another person's account without permission;
- reverse engineer, decompile, disassemble, modify or create derivative works from the App, except where applicable law does not allow that restriction;
- scrape the Service, use automated tools to collect content or data, or bypass access, payment, territorial or security controls;
- use the Service in an automated, abusive, commercial or non-personal manner, or in a way that places an unreasonable or disproportionately large load on our systems;
- remove, alter or obscure any copyright, trade mark or other proprietary notice appearing in the Service or its content;
- use any Service content or data to train, test, develop, benchmark, validate or improve an artificial-intelligence or machine-learning system without our prior written permission;
- interfere with the Service, introduce malicious code, probe security, overload systems or attempt unauthorised access; or
- use the Service for fraud, unlawful activity, infringement or harm to another person or their rights.
We may investigate suspected misuse and suspend or end access where reasonably necessary to protect the Service, users, rights holders or the public.
7. Availability and changes
We work to keep Still Sky reliable, but the Service may sometimes be unavailable because of maintenance, updates, technical problems, internet or third-party services, legal requirements or events outside our reasonable control. We do not guarantee uninterrupted, secure or error-free access.
We may change or discontinue part or all of the Service. Where reasonably practical, we will give notice of a material change that significantly affects an active paid subscription. Do not purchase a subscription based on an expectation that a future feature will be released.
8. Privacy
Our Privacy Policy at https://stillskyapp.com/privacy explains how we collect, use and protect personal information. It forms part of your agreement with us.
9. App stores and third-party services
If you download the App from Apple's App Store, Apple's applicable terms also apply, including Apple's Standard End User Licence Agreement unless we provide a custom licence through App Store Connect. If you download the App from Google Play, Google's applicable terms also apply to that version. If these Terms conflict with a mandatory app-store term, the mandatory app-store term controls for that issue.
Apple is not responsible for operating or supporting Still Sky. For an Android version distributed through Google Play, responsibility for operating and supporting that version remains with us except where Google's mandatory terms or applicable law provide otherwise. Questions, complaints and claims about the Service should be directed to us at [email protected]. You must also comply with any third-party terms that apply to your device, network or services used with Still Sky.
The Service may link to third-party websites or services. We do not control them and are not responsible for their content, availability or privacy practices. Your use of them is subject to their own terms.
10. Ending use or closing an account
You may stop using Still Sky at any time and may request account deletion through Settings > Account > Delete Account. Account deletion is separate from cancelling an app-store subscription.
Account deletion is generally irreversible. Your progress, preferences and other account information may no longer be recoverable after deletion. We will delete or retain personal information as described in our Privacy Policy. Deleting an account does not cancel or refund an app-store subscription.
We reserve the right to suspend or terminate your account or access to some or all of the Service if you materially breach these Terms, fail to pay amounts properly due, misuse the Service or its content, engage in fraudulent or unlawful conduct, attempt to bypass payment or security controls, or create a material security, legal or safety risk. Where reasonably appropriate, we will give notice and a reasonable opportunity to resolve the issue, unless immediate action is reasonably necessary. Suspension or termination of access may not automatically cancel a subscription billed through an app store. You should check and, if necessary, cancel the subscription through the store that billed you. Refunds are subject to applicable law, the relevant app-store rules and Section 4.
When these Terms end, your licence ends. Provisions that by their nature should continue—including ownership, indemnity, disclaimers, liability, dispute and general provisions—will survive.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available". We do not make promises about uninterrupted availability, error-free operation, accuracy, fitness for a particular purpose or specific results, except for rights and promises that cannot lawfully be excluded.
Nothing in these Terms limits any mandatory consumer guarantee, warranty or other right that applies to you under the law where you live.
12. Limits on liability
To the fullest extent permitted by law, Still Sky will not be liable for indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, business, goodwill or data, arising from the Service.
To the fullest extent permitted by law, our total liability for claims connected with the Service will not exceed the greater of (a) the amount you paid for Still Sky during the 12 months before the event giving rise to the claim and (b) INR 3,000, or the equivalent in the currency in which you paid, calculated using a reasonable prevailing exchange rate when the liability is finally determined.
These limits do not apply to fraud, wilful misconduct, liability for death or personal injury caused by negligence where it cannot be excluded, or any other liability or consumer right that applicable law does not allow us to limit.
13. Indemnity
To the fullest extent permitted by applicable law, you agree to indemnify, defend and hold harmless Still Sky, its operator, successors, permitted assigns, licensors, service providers, contractors, personnel and representatives from third-party claims, proceedings, liabilities, damages, judgments, settlements, losses and reasonable legal costs arising from or relating to: (a) your unlawful, fraudulent, unauthorised or commercial misuse of the Service or its content; (b) your material breach of these Terms; (c) your violation of applicable law or another person's intellectual-property, privacy or other rights; (d) your introduction of malicious code, interference with security or attempted unauthorised access; or (e) activity through your account resulting from your intentional sharing of account access or failure to take reasonable steps to protect your login details.
We may assume control of the defence or settlement of a covered claim, and you agree to provide reasonable cooperation. We will not settle a claim in a manner that requires you to admit wrongdoing or undertake a non-monetary obligation without your consent. This section does not apply to the extent a claim was caused by our unlawful conduct, negligence, wilful misconduct or breach of these Terms.
14. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to any mandatory consumer forum or local jurisdiction available to you, the courts of competent jurisdiction at Lucknow, Uttar Pradesh, India will have exclusive jurisdiction over disputes connected with these Terms or the Service.
Nothing in this section prevents either party from seeking urgent protective relief or using a consumer forum, regulator or remedy that applicable law makes available and cannot be waived.
15. Changes to these Terms
We may update these Terms when the Service, our business or the law changes. We will post the updated Terms and change the date above. If a change materially affects your rights, we will provide additional notice where reasonably appropriate.
The updated Terms apply from their stated effective date. If you do not agree to a material update, stop using the Service and cancel any renewal before the next billing date.
We may provide operational, legal and account-related notices by email to the address associated with your account, through the App or by posting them on our website. You must keep your account email address current. Notices will be treated as given when sent or posted, subject to applicable law.
16. General
These Terms and the Privacy Policy are the entire agreement between you and us about the Service, except for terms shown at purchase or required by an app store. If a provision is unenforceable, the rest remains effective. A delay in enforcing a right is not a waiver.
You may not transfer these Terms without our consent. We may transfer these Terms and the operation of Still Sky to a company formed to carry on the business, or as part of a financing, reorganisation, sale or transfer. We will provide notice if that materially affects your rights.
